These Terms & Conditions ("Terms") govern your access to and use of all services, products, digital goods, and content provided by By Hand & Flame, LLC ("we," "us," or "our"). By placing an order or using our website, you agree to these Terms in full. Please read carefully.

General Conditions of Sale

All products sold by By Hand & Flame, LLC are intended for personal, spiritual, or educational use. By purchasing from us, you confirm that you are at least 18 years old and legally able to enter into binding agreements. Certain products may require additional age verification, outlined in Section 6.

Product Disclaimer & Spiritual Use

Our items are crafted with care, intention, and years of personal experience. Many have been used successfully in spiritual practice for over a decade. However, we do not and cannot guarantee the outcome or effectiveness of any magical or spiritual product. Each user’s results may vary depending on their intent, focus, and energy.

By purchasing, you acknowledge that these tools support your personal practice, and results are not guaranteed. The use of our tools is a deeply personal journey, and we encourage responsible, ethical, and informed use.

Order Processing, Fulfillment & Shipping

  • Orders are processed and fulfilled within 5 business days, excluding weekends and holidays.
     

  • All products are handmade or hand-assembled to order. Certain items, especially customized or ritual-prepared tools, may require additional preparation time.
     

  • Tracking information will be emailed once your package has been shipped.
     

  • Pre-orders or backorders may occasionally be offered on a case-by-case basis.

Custom Orders

We welcome custom orders. Some may require additional correspondence and approval.

  • If we reach out to confirm details or obtain clarification and do not receive a reply within 7 calendar days, your order will be cancelled and refunded.
     

  • Due to their specialized nature, custom orders are only eligible for refunds or replacements in cases of verified damage or loss in transit.

Refunds, Returns & Replacements

Refunds are available only under specific conditions:

  • Items that arrive damaged, defective, or are lost in transit are eligible for a refund or replacement, subject to approval.
     

  • All refund requests must be submitted via our [Refund Request Form], located beneath the Refund Policy on our website.
     

  • All requests are individually reviewed and not guaranteed until approved.
     

Returns are accepted only for non-magical, unopened physical items, such as t-shirts or books, and must be returned in original condition.

Please note: Free promotional items included in your order are not eligible for return, replacement, or refund under any circumstances.

Age-Restricted Items & Legal Compliance

Certain items may include materials or themes not suitable for minors.

  • Baneful products and any items with age-restricted components require age verification.
     

  • These items will not be sold to individuals under 21, or to individuals purchasing on behalf of someone under 21.
     

  • Additional verification may be required before such orders are processed or shipped.
     

We reserve the right to cancel or deny any order if we suspect a violation of this policy.

Health, Legal, and Ethical Use Disclaimer

Our products and services are not intended to diagnose, treat, cure, or prevent any disease or medical condition, nor should they be considered a substitute for professional legal, medical, psychiatric, or ethical advice.

  • Any ritual, herbal, or spiritual product should not replace the advice of a licensed healthcare or legal professional.

Purchasers are responsible for checking their local laws before using herbs, resins, or any ritual ingredients.

Digital Products

In the future, we may offer downloadable materials (e.g., PDFs, e-books, tutorials).

  • All digital products are non-refundable.

  • Use of digital content is for personal, non-commercial use only, unless otherwise stated.

Ethical Use of Products

We take ethics seriously in our practice and expect the same of our customers.

Unethical or abusive use of any of our products is strictly against our policy. Even baneful or defensive spell materials must be used responsibly, in a way that is proportional to any harm done to the user, and never for unprovoked or malicious reasons.

 

Any public or private misuse of our products, especially involving harm or incitement of harm to others in unethical or illegal ways, will result in legal action up to and including court proceedings.

Ethical Use of Products

All orders may include free promotional items. These are added at our discretion and:

  • Are not eligible for refunds, replacements, or exchanges.

  • Are not guaranteed and may vary by order or availability.

Educational Mission & Resources

Every order includes educational material to empower and inform our community. Whether you are new to the craft or an experienced practitioner, we believe knowledge and intention go hand in hand.

 

We provide guides, usage notes, and additional digital resources whenever possible.

Free Educational Materials & Blog Posts

Any free educational materials, blog posts, downloadable files, and written resources available on our website or provided with your purchase are the exclusive intellectual property of By Hand & Flame, LLC.

These materials are offered for personal use only and are not to be reproduced, shared, resold, printed for commercial purposes, or published without our express written permission. Unauthorized distribution or reproduction constitutes a violation of our intellectual property rights and will be addressed with legal action.

Intellectual Property & Communications

All written content, branding, product inserts, spell instructions, digital files, website content, blog posts, social media posts, communications, packaging text, artwork, photographs, and video materials are the sole property of By Hand & Flame, LLC, unless otherwise stated.

These materials may not be copied, reproduced, modified, shared, or distributed for commercial use, resale, or republishing without written permission. This applies regardless of whether content was received through a purchase, download, subscription, or free promotional offering.

Any misuse, theft, or violation of these intellectual property rights will result in legal enforcement up to and including court proceedings.

Sustainability Commitment

We are committed to minimizing waste and being intentional with every part of our process. Our products are packaged with recyclable, reusable, or biodegradable materials whenever possible. We reuse shipping materials to reduce waste and support low-impact practices in sourcing our herbs, oils, and ritual tools.

As part of our sustainability efforts:

  • Orders ship in recyclable or compostable packaging when available.

  • We offer a $2.99 candle upgrade option to receive pure beeswax candles for a more eco-friendly experience.

  • We regularly evaluate our supply chain for ethical sourcing and sustainability compliance.

Pre-Orders & Backorders

Pre-orders and backorders are accepted on a case-by-case basis. You will be notified of estimated shipping timeframes, and refunds may be requested if delays exceed reasonable limits.

Storefronts, Listings & Marketplaces

By Hand & Flame, LLC operates on our website and through Etsy. All policies stated here apply to all purchases, regardless of where they were made. For marketplace-specific rules, please consult the policies of the platform (e.g., Etsy’s Privacy and Buyer Protection Policies).

Influencer and Promotional Outreach

By Hand & Flame, LLC may engage with influencers, content creators, affiliates, or promotional partners ("Promotional Partners") to showcase or review our products or brand. All such collaborations are subject to the following conditions:

 

  • Authenticity & Transparency: Promotional content must clearly disclose the relationship between the Promotional Partner and By Hand & Flame, LLC in accordance with FTC guidelines, including the use of hashtags such as #ad, #sponsored, or other required disclaimers.​

  • Content Usage Rights: By Hand & Flame, LLC does not claim ownership of any content created by Promotional Partners. However, by participating in a promotional collaboration, the Promotional Partner grants By Hand & Flame, LLC a non-exclusive, royalty-free, perpetual license to repost, share, or feature the content—solely for the purpose of advertising or promoting By Hand & Flame, LLC products or services. This may include use on our website, social media, newsletters, and other marketing platforms. All credited use will respect the creator’s identity and intellectual property, and we will never alter or resell the content without express permission.

  • Brand Representation: Promotional Partners are expected to reflect the values of By Hand & Flame, LLC—ethical use, respect for diverse magical paths, and a commitment to responsible spiritual practices. Misrepresentation, misinformation, or unethical behavior will result in termination of the partnership and possible public disassociation.

  • No Guaranteed Partnership: Submitting a request to promote or represent our brand does not guarantee acceptance. We retain full discretion in selecting collaborators based on alignment with our values, brand image, and audience fit.

  • Promotional Compensation: All compensation (monetary or in-kind) will be mutually agreed upon in writing prior to any promotion. Free products sent for review are not eligible for return, refund, or resale.

Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a new effective date. Your continued use of our website or services indicates acceptance of any changes.

The Ember Circle T&C

The Ember Circle Loyalty Program & Marketing

Membership and Eligibility


 The Ember Circle is By Hand & Flame, LLC’s official loyalty program. Enrollment is free and available to all customers with a registered account on our website. By enrolling, you agree to abide by all policies, terms, and conditions outlined in this document and elsewhere on our site. By signing up for The Ember Circle, you will also be subscribed to our newsletter and marketing communications. Likewise, subscribing to our newsletter automatically enrolls you in The Ember Circle. You may update your email preferences at any time, though opting out of communications may result in missing loyalty-related updates and offers.


Earning Sparks


 Members earn Sparks (points) for eligible purchases at a rate of 1 Spark per $1 spent (excluding taxes, shipping, and discounts). An initial bonus of 50 Sparks is awarded upon account registration. Additional Sparks may be awarded through promotions, bonuses, or other actions at the discretion of By Hand & Flame, LLC.


Redeeming Sparks


 Sparks can be redeemed for flexible rewards at a standard rate of 10 Sparks = $1 discount. Redemption thresholds and available reward options may vary and are subject to change without notice.


Expiration and Forfeiture


 To encourage consistent engagement and fair use, 50% of earned Sparks will expire 12 months after the date they were accrued, unless otherwise specified. Sparks are non-transferable, have no cash value, and may not be exchanged, refunded, or applied retroactively.


Termination and Program Changes


 By Hand & Flame, LLC reserves the right to modify, suspend, or terminate The Ember Circle program, or any part of it, at any time without prior notice. Abuse, suspected fraud, or violation of program or site terms may result in revocation of membership and forfeiture of Sparks.


General Conditions


 Participation in The Ember Circle constitutes acceptance of these terms. All other policies—including those on privacy, shipping, refunds, and ethical use—apply equally to The Ember Circle and its rewards.
